“Service provider”: Neosay Technologies and solutions Pvt Ltd, its partners or any of its Franchisees.
“Customer”: School/College Management, Parent and All End users of the NeoTrack product and solution.

NEOTRACK TERMS OF USE:
NeoTrack is a product of Service provider. This agreement is between Service provider and the party (henceforth referred to as ‘the “Customer”’) who purchases the NeoTrack product or under NeoTrack service (henceforth referred to as ‘the product’) from Service provider.
The product comprises of Vehicle tracking hardware, RFID reader, RFID cards, Microphone, Video DVR, camera and other sensors and actuators to be installed in the Customer’s vehicle (henceforth referred to as ‘the device’), and an online vehicle tracking application and SMS alerting solutions (the two of which are together referred to as ‘the service’). Service provider does not assume any responsibilities and cannot be held liable if this product was not obtained from an authorized reseller as appointed by Service provider. Only users who have agreed to these terms and conditions are allowed to use this product. Service provider disowns all responsibility and liability if this device is used by a person who has not agreed to these terms and conditions.

Service provider role is limited to providing a solution to tracking, alerting & reporting vehicles through its service as configured by the “Customer”. While Service provider makes every effort to make the vehicle tracking, alerting & all the related features of NeoTrack enhancing the safety &/security of vehicle& passengers, Service provider does not and cannot claim to eliminate entirely the safety & security risks in the passengers/goods transportation.

Other aspects like running condition, operational safety, security, spare parts, accessories, components, tools availability and safety in the tracked vehicles do not fall within the ambit of the company’s operations and assistance. The company does not own any responsibility / bear any liability or loss in relation to any of the above mentioned contingency, found in the tracked vehicles. Our liability will be limited to the price paid for the product and service.

Disputes: All disputes that may arise in relation to the usage and application of the product shall fall within the legal and territorial jurisdiction of Coimbatore. In the event of any dispute arising under the agreement, the same shall be referred for settlement by arbitration of three arbitrators, one each to be nominated by each parties and the third arbitrator to be appointed by the said two nominated arbitrators. The arbitration proceedings shall be governed by the Indian Arbitration and Conciliation Act, 1996 or any statue, amendment or re-enactment thereof. The place of arbitration shall be at Coimbatore and the Court of Coimbatore alone shall have the jurisdiction.

Installation of the NeoTrack device should happen only through an authorized person appointed by Service provider or designated person by the “Customer” under Service provider supervision. Your warranty is void if an unauthorized person installs or tampers with an installed NeoTrack device. We disown any liability from such a NeoTrack device that has been tampered with. We also disown all liability if any other problems with your vehicle’s battery or other components affect the installed NeoTrack device and cause it to malfunction. Service provider provides a warranty for a full service/replacement of a NeoTrack device, for the mutually agreed service period. This warranty covers the NeoTrack device against manufacturing or product defects only. This warranty does not cover damage caused by accidents, improper use, mishandling of the device or failure due to external factors like liquids, breakages etc.

We do not warrant that the service will be available at all times, as it may be down for maintenance or as a result of a fault. We will try to fix faults as quickly as we can. While Service provider has taken all precautions in keeping the service bug free and robust, it cannot guarantee that the service will always be up and working. Service provider does not guarantee reliable operation of the product under circumstances like GPS errors, GSM network issues, server breakdowns, software problems etc. However Service provider will try our best to ensure on the service. We may make any changes to any feature (like changing of the maps used) in the NeoTrack device or service without prior notice.
We will not accept liability for any loss or damage incurred by you or any third party arising from the use of the product/solutions. Use of the product is not a substitute for proper care and supervision of the item to which the device is attached. It is your responsibility to ensure you have any relevant insurance and to consider and decide whether the product is appropriate for your needs. While Service provider makes every effort to ensure all features of the product are as accurate and reliable as possible, due to technological and other limitations we cannot guarantee accuracy. The entire service or some of its features might be changed or discontinued at any time without prior notice.

We do not accept liability for any losses, or for loss of profit, business or revenue, whether direct or indirect. If at any time we believe that you have broken these terms or the terms of any other agreement with us, or are using the product improperly or illegally, we may terminate or suspend the provision of the service immediately without any notice.

Service provider bears the rights to stop extending its support any time after sales, in which case only the device will be owned by the buyer if he had purchased the device and the service may or may not be available for him. If the services are stopped by Service provider, the monthly service charges for the remaining months alone will be refunded back .If the monthly charges are not paid, Service provider deserves rights to stop the service. The device will be removed from the school busses and the ownership transferred (in case of service model buy-out) to Service provider on termination of the service contract between the school and, Service provider.

Device being installed in the “Customer’s transportation vehicle, “Customer” holds the complete responsibility to use it only for government allowed lawful purpose without any deviation to government rules & regulations. The “Customer” holds the complete 100% responsibility of the SIM cards used in the device. “Customer” should take all measures to protect the sim card only for the intended GPS data transfer via GPRS purpose, Alert/Tracking info SMS& voice call during SOS events. Any misuse of the device & the SIM card will be at the sole responsibility of the “Customer”. NeoTrack SMS will be sent to the desired recipients shared by the “Customer”. “Customer” has to ensure the correctness of the give mobile number and owns all responsibilities.
We will collect your personal information when you buy NeoTrack. As part of the NeoTrack service, we will send you SMS, e-mails and other messages and alerts, according to the way you have configured the service, and to inform you of changes or problems to the contact information you have provided. You and your authorized recipients will receive SMS alerts related to NeoTrack even if you have subscribed for DND facility.

CHARGES
You will be charged annual charge or a biannual charge or a term subscription or a monthly charge for the service provided. Service provider reserves the right to raise or lower subscription fees based on the market conditions prevailing at the time. In case of devices under the ownership of the Service provider and they are damaged due to mishandling or lost by the “Customer”, the “Customer” will be charged additional for the devices to be replaced.

USE OF CONTENT
All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned or used under license, by the business and/or it’s associate entities who feature on this website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.
You may not sell or modify the content of this website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organization’s or entity’s written permission.

CANCELLATION & REFUND POLICY
Our focus is complete customer satisfaction. In the event, if you are displeased with the services provided, we will refund the money, provided the reasons are genuine and proved after an investigation. Please read our policies of each deal before buying it, it provides all the details about the services or the product you purchase/subscribe. In case of dissatisfaction with our services, customers have the liberty to cancel their subscription and request a refund from us. Our Policy for the cancellation and refund will be as follows:

Cancellation Policy
For Cancellations please contact us via contact us link. Requests received later than 3 business days prior to the end of the current service period will be treated as a cancellation of services for the next service period.

Refund Policy
We try our best to create suitable design concepts for our customers. In case any customer is not completely satisfied with our products we can provide a refund. If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payment gateway, payments refund will be made to the same account. Refunds will be processed within 7 business days.
